Meyiwa murder trial: Court to dig into status of second Kelly Khumalo docket

Who is Advocate Teffo Representing

The infamous second docket was first brought in court last month by advocate Malesela Teffo. The case hearing about the death of former Bafana Bafana captain Senzo Meyiwa is set to continue on Monday in the Pretoria Magistrate’s Court, with the court expected to gain clarity on the controversial second murder docket in the case.

Judge Tshifhiwa Maumela postponed the trial last Wednesday after a request from a defense lawyer, advocate Zandile Mshololo, who represents one of the five men standing trial for the murder of the soccer star in October 2014.

Advocate Mshololo asked for the postponement after the state provided her with the second docket in the murder case.

The infamous second docket – known as case 375 – was first brought in court last month by a defense lawyer, advocate Malesela Teffo, during his cross-examination of forensic detective Thabo Mosia.

The docket allegedly recommended that Meyiwa’s girlfriend, singer Kelly Khumalo, and six other people be charged with murder and defeating the ends of justice in connection with Meyiwa’s murder after Khumalo accidentally shot him at her mother’s Vosloorus house in 2014.

Status quo of second docket

During court proceedings last Wednesday, advocate Mshololo argued that her client, Sifisokuhle Ntuli, was prejudiced by the late disclosure of the second docket when the trial had already started.

“The non-disclosure of such a document to accused number five violated his rights to be given further particulars [and] all information that owns the state to prepare his defense,” Mshololo said.

Mshololo asked Judge Maumela to adjourn the trial for her to study the contents of the docket and ascertain its status quo from the National Prosecuting Authority (NPA).

“If there are two decisions, one taken by the director of public prosecutions in South Gauteng and the other one taken by the director of public prosecutions in North Gauteng, to charge the accused before this court; then I need clarity on that from the NPA before I can be able to proceed with cross-examination,” she said.

Five men – Ntuli, Muzikawukhulelwa Sthemba Sibiya, Bongani Sandiso Ntanzi, Mthobisi Prince Ncube, and Mthokoziseni Ziphozonke Maphisa – face a string of charges over Meyiwa’s murder on 26 October in 2014

The group has pleaded not guilty to the charges against them.

Senzo Meyiwa trial: Heated exchange between Judge Maumela and Adv Teffo

Pretoria: After adjourning court proceedings on the Senzo Meyiwa murder trial last Wednesday, the proceedings resumed on Monday with a rather bitter exchange between advocate Malesela Teffo and Judge Tshifhiwa Maumela.

The court was ready to get feedback from advocate Zandile Mshololo on the second docket opened on the Meyiwa murder case, which she received Wednesday, June 8.

Mshololo, upon receiving the docket, asked the court for an adjournment to go through the docket.

“I need to be heard, please,” Teffo told Maumela.

Maumela denied Teffo the chance to speak, saying Mshololo had to make her presentations first.

“The problem I have is that, when advocate Teffo thinks it’s time for him to speak, things must happen. The other day I had to warn you when you demanded things to happen.

“I’m saying now, as the presiding officer, in this case, it is time to allow advocate Mshololo to proceed with what she started in your absence. She is not done,” Maumela said.

Despite Maumela’s refusal, Teffo did not want to stop with his request and argued that he should be allowed to speak.

“I made a ruling, advocate Teffo, that we are not going to debate about what you want to talk about,” Maumela said, raising his voice.

After lunch, the exchanges continued, Teffo wanted to respond to Mshololo’s submission, but Judge Maumela told him its advocate George Baloyi’s time to speak.

“You just jump up,” Maumela said to Teffo.

Teffo responded to Maumela by saying he is beginning to realize that he and Maumela “come from a different school of law, that’s why we clash.”

Meyiwa was gunned down in October 2014 at his girlfriend Kelly Khumalo’s home in Spruitview, Vosloorus.

Five men are standing trial for his murder.

Teffo was later allowed to make his representations.

The trial continues on Tuesday.
